2. Purpose of the Website
This Website is a directory of marriage celebrants in Australia. It exists for the betterment of search results and to help couples find Commonwealth-authorised marriage celebrants. The directory is provided as a free informational resource.
We are not a marriage celebrant booking service. We do not act as an agent, intermediary, or broker between couples and celebrants. Any engagement of a celebrant listed on this Website is a matter solely between the couple and the celebrant.
3. No endorsement, guarantee, or warranty
A listing on this Website does not constitute an endorsement, recommendation, guarantee, or warranty of any kind by Joshua Withers, Withers XYZ Pty Ltd, the Snow Withers Trust, or any of our affiliates regarding any celebrant's:
- suitability, competence, or fitness for purpose
- quality of service or professional conduct
- registration status with the Attorney-General's Department
- insurance or qualifications
- availability, pricing, or terms of service
While we endeavour to verify information provided to us, we do not guarantee the accuracy, completeness, or currency of any listing or information on this Website. You should independently verify a celebrant's registration status, qualifications, insurance, and suitability before engaging their services.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
4. Celebrant listings and applications
Celebrants may apply for a listing on this Website. Submitting an application does not guarantee or entitle any person to a listing. We reserve the absolute right to:
- accept or refuse any listing application at our sole discretion, without providing reasons
- remove, modify, or suspend any listing at any time and for any reason
- assign, change, or revoke tier status (Registered, Endorsed, or Luminary) at our sole discretion
- modify the criteria for any tier at any time
- edit listing content, including descriptions and images, for quality, accuracy, or consistency
Celebrants are responsible for the accuracy of information they submit. By submitting a listing, celebrants grant us a non-exclusive, royalty-free, worldwide licence to use, display, and modify the content they provide for the purposes of operating the directory.
5. Changes to the Website
We reserve the right to modify, suspend, or discontinue the Website (or any part of it) at any time, without notice and without liability. This includes changes to content, features, design, tier criteria, listing requirements, and these Terms and Conditions.
We may update these Terms and Conditions from time to time. The "Last updated" date at the top of this page will reflect any changes. Your continued use of the Website after changes are posted constitutes acceptance of the revised terms.
6. Limitation of liability
To the maximum extent permitted by Australian law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)):
- We are not liable for any loss, damage, cost, or expense (whether direct, indirect, incidental, special, consequential, or otherwise) arising from or in connection with your use of or reliance on this Website, any listing, or any information provided on or through this Website.
- We are not liable for any acts, omissions, conduct, or services of any celebrant listed on this Website.
- We are not liable for any loss arising from the unavailability, interruption, or malfunction of this Website.
Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement. If we are liable under any non-excludable provision, our liability is limited to the maximum extent permitted by law.
